Utah Sex Offender Registry

Utah Code Ann. §77-27-21.5, The Sex and Kidnap Offender Registry requires the Utah Department of Corrections to develop, operate and maintain a registry of persons who have been convicted of certain offenses. Those offenses are listed in subsection (1)(g) or (n) of the statute.

The system does not seem to protect the victims who are disabled. My son (who is autistic) was molested by his father for 6 years before he was able to tell someone. We went through the system, police, county attorney, children’s justice center, and received victim’s reparation. Everyone believed him, but the prosecutor did not prosecute. Now the father is free, may be continuing with other disable son, and wants to work with Special Olympics again.

Where is the justice? What can be done? Who is protecting the inoccent?

Utah is not helping the most innocent, the disabled. My son was sexually molested by his father for several years before he felt safe enough to tell someone. At the time he told someone he was 18 years old he is autistic, mentally challenged, seizure disorder, and upper motor neuron disorder. The local police were called, an investigation completed, children’s justice center did a physical exam, he was given therapy by rape recovery services. All of these people have worked with my son, feel he is telling the truth, or there is physical evidence. My son's father was questioned and was felt that he was lying and the detective felt he was guilty. Then it was given to the county attorney and he decided to "pass on it”. My son was not creditable to go through a trial they say.



Where is the justice for this group of individuals? Who is helping them stay safe from there own friends and family? Why is his dad still walking out there possible preying on others? We have another disable son and with no conviction I have no resources to keep him safe. He is also returning to his volunteering with special olympics. Where is the justice?

Joan...the police did not request him to take a lie detector test?

Many offenders can manipulate enough to slip under the radar. You can still keep an eye on him and see if he chooses a "favorite" child. Or , if he is creating reasons for children to "stay overnight" with him. I'm sure he won't get away with it a second time and you should participate if it goes to court on another case. Then again, he is considered innocent until nabbed. Educate yourself on the warning signs of sexual offense.

Is there a way to report anonymously a case of adult having sex with underage girl in South Jordan Utah?

The parents are feared for unknown reason so they keep quiet. But i just want to stop this insanity!

Hope you get some answers for this question. I would call the Dept of Human Services at your state and tell them of your problem. They may suggest a way to help you. Tell them you want to talk to someone about an ongoing sexual abuse situation.

I will have to agree with you that Utah needs to do more to protect kids against sex offenders. I know of some one that gave his information and a major Pizza company allowed him to work for them with under age children and now he is back in prison Thank GOD!! but still he should have never been allowed after he was convicted the first time to be put in a work area with kids. Utah needs to protect the kids

Sex offenders are the saddest excuse for human beings on the face of the planet. In my opinion, they can never reform because their desires are hardwired into their brain from birth. These 'people' should never be released from jail, and/or prison. There are so many in my area and I'm afraid to let my sister play outside by herself. The legislature should create new laws with harder crackdowns on sex offenders. Their punishments are pretty small compared to what other crimes are punished. Murder is just as bad as a sexual crime and should adhere to the same guidelines. Ugh, you people make me SICK.

what about the few people charged as sex offenders that were simply lie to about the true age of the party they "supposedly" made a victim. i think the girls and boys who lie about their age and get another person charged with such a horrible label should be the one put in jail!

I absolutely agree with the girls lying about their age. What the heck is up with allowing that? Before I met my husband, he had some friends over and made out with (no sexual) a girl that claimed to be an adult and had a child. When her friend threatened to tell the girls boyfriend then the girl panicked and told the police that my husband touched her breast over her shirt. (I read the police report.) Well, the girl was 17 (she did have a child). He was arrested, spent time in jail, was on probation for 3 years, went through humiliating tests, attended court ordered therapy three times a week for three years, then after that was placed on the registry for 10 years. She ruined his life. The laws keep changing and he has to keep complying to them and the humiliation of the woman he has to register with every year. Guess what? The PO told my husband she is a victim of a sex crime herself. She is vendictive and emotional and should not be in that position. Non violent offenders should not be on the website.

Most of you seem to have the same opinion. BASH the offender. My opinion is OK fine put the sex offenders on a web site, Let society know the exact cause and nature of his/her crime. Yet lets not stop there, Lets put drug dealers/users, theifs, any other criminal convicted of a crime on a web site. Lets let the public ruin their lives for 10 years +. Oh lets not forget speeding, bouncing a check, shop lifting, etc... Seems ridiculous doesnt it. Since I am on the web site I say to you get your facts in order and dont throw stones if you live in a glass house. I would have to only guess but I would say that most people as in myself were forced into a guilty plee to protect the children from a court room. In my case it was a matter of not locking a door.

Putting offenders on a website is done for punishment, IMO. The old "Scarlet Letter". Why not just let the police keep a registry. After all, isn't it their job?

My son was convicted as a sex offender put in prision, and put on the list because he had a cousin show him something that he showed another cousin. His sex crime is he showed a cousin how to sexually arrouse himself then masturbate. His cousin has showed other friends the same things but he is not in prison nor on a list. Some of you make coments that sex offenders should be put to death. I love my son very much. He did something he shouldn't have done as a teenager which he regrets but can't take back now. I know for a fact that many young people do these things but putting them in prison, on a registry for life or even putting them to deaath is such a horrible way to think. You are thinking of people who are on these registries as monsters some of them were just miss guided "human beings" just like you. Judge not that ye be not judged.

I have a family member who is on the sex offender registry - I also have some family members who have been sexual abuse victims - I also have a family member who has been a drug dealer - MY POINT - the drug dealer has done far more damage to MANY peoples lives than the one sex offender!!! If the sex offenders need to be posted for the world to see why not post the drug dealers too? Then we as a "perfect society" can watch all these preditors. WHAT A SICKO IDEA!! Why not ALLOW these people (sometimes wrongly accused) to get on with their lives once their time is served and gotten the necessary help. THEY ALL CAN BE REFORMED!... including the drug dealers!

In Maine, last week, some self righteous souls at the Dept. of Corrections, decided to set up a website to put ALL criminals on the web. Anyone in prison! On grounds that it would help the victims. Believe me, the victim knows he/she is in prison and can call anytime! The gov and committee on criminal justice were never informed. It has been stopped, temporarily. The last folks to do this were Hitler's men. Criminals are members of ALL of our families. They need to be properly punished by our system and then start over (hopefully learning right from wrongs) IMHO. The woman in the corrections dept. that supported this, ought, in my opinion, to be flogged for her own sins!

Society creates it's own monsters and deserves what it gets. If you want to continue to keep reformed sex offenders on the website and make them feel like s---, then society deserves the consequences that follow (Duncan, Couey). I am not saying that what they did is right, it isn't. They were completely in the wrong and deserve the death penalty, but think about this (they were both non-compliant). For those who don't know what Non-compliant is: they were not where they were supposed to be. Why do you think that is? Yet, you seem to think that those who have worked their a--e- off and are compliant should have to be judged for life. Well, guess what Couey and Duncan didn't think it was right to be judged for life and guess what? Well, maybe you get my point. The registry should be reserved for those who are a threat. The longer a person is out without any victims, the less the threat. Be careful what you people create. I know drugggies that go in and out of prison once or twice every two or three years and all the SO's I know have not gone back at all. Hmmm, who is the real threat? And if you think SO's are a threat and druggies aren't, answer this question: Why do they go to jail or prison if it isn't so bad. It is against the law. Maybe this is your test from God to see how well you treat others. In the bible it says that Jesus was tempted on everything so that he could die on the cross for our sins. Everything. He overcame the temptation, but at least he knows why he died for the Sex Offender too.

Sex Offender Laws = votes for politicians... Nothing more... Did you happen to see what the politicians who supported the now ON HOLD law in Utah concerning warrantless search and siezure of non-probationer sex offenders --- did you see the act he tried to put on? But, that's ok they may tell society the RSO will molest thier kids, but the fact is that 90% of all new sex crimes are being committed by people who are not on the sex-offender registry... Here in Utah, the recividism rate of registered sex offenders is less than 1%; yet, we are all at danger.... give me a break.

I was 17 and had a boy friend 3years younger then me. When i turn 18 the law hit me with csc3ed. Im no rapest or monster. Im a mother of 4 and i cant go to there school i cant go on fild trips my kids are the ones hurting along with me. 25years the law gave me for what? My po even said she wish she could help me cause its RONG. Every thing takes money and money i just dont have. I am a good mother and person, someone can go and hurt a helpless child in a nasty act and get csc3rd and god help there sole an that poor baby then you got LOTS of people like me that never held any child down or made them do any thing the csc reg. says. Im sending this so may be someone could help me and many people like me. This hurts our lifes!!! PLEASE!!!! THANK YOU>

I read the comment that drug dealers do more damage than sex offenders. That made me mad. You are acting like that isn't a bad thing. There are offenders whose crimes weren't so bad maybe, But there are also MONSTERS!!!! I am a victim myself. I also used drugs when I was younger, thanks to the man who screwed me up. I have no effects from drugs now, but 18 yrs. later, I am still having nightmares from my abuse. Older men raping innocent little girls is sick!!! They shouldn't be put to death. They should be tortured so they can live with the pain they caused but theirs would not last as long. Therefore the point that was made about drugs being worse is screwed up!!!!! I am talking about the monster sex offenders.

I was reading some of the articles on this site and would like to share my story. I got married to my soon to be ex husband 3 years ago. I thought god had answered my prayers with this man I loved him so much. A few months after we got married I found out my husband had been cheating on me since the day we got married. This was upseting but not nearly as upsetting as what came next. I did forgive my husband for this, and allowed him back in my home. Soon after my then 11 year old daughter started acting out. Burning herself, failing school, a once outgoing child turned unsocial and started hearing voices in her head telling her she was ugly, and everyone hated her, and that she was better off dead. I did the only thing I could do, and started taking her to a child therapist. ultimately waht I found out was that my husband had been going into her room several times a week and masturbating while he thought she was asleep. finally it went farther than that and he decided to put his hands down her pants. I dont understand how a man that was so protective over his children he would not let them walk to the store down the street alone could be this person! Its like I have been living with a stranger. He has a daughter that is 12 years old that he has every weekend I am very concerned for her. I told his mother and his ex wife my concerns and they ignored me. After this happened I went to the local police department and got all of the previous sex offense complaints that had been filed against him. By the way there were four. none of the previous victims wanted to push the issue any further, so they were just left as complaints. I cant help but think that if one of those people had the strength or desire to move forwrd maybe my daughter would not be a victim? This is why the buck stops here. We are moving forward and the county prosecuter is planning to file this case. I am welcome to any comments you may have,

anon 27th, utah: How close to you? Offenders are in your family. Some are close friends. You can't protect your girls trusting only the registry. You need to teach them right and wrong touching. Get to it and forget about people that have already been caught. It's the ones that are not caught you want to deal with. (IMO)

my father is on the utah state sex offender registry. i was there when the suppossed "molestation" occured. the boy that accused my father was my best friend and he didnt like my dad because my dad wouldnt buy the boy ciggarettes. he was 9! i wouldnt have done it either. so the boy went and said my dad touched him. i think that some databases could be better but, i also think that the investigations should be better as well. my dad has to be in prison until 2009 and has been there since 1999. for something he didnt even do. i am NOT defending sex offenders for i have been abused myself but my father is spending time as an innocent man.

I have spent time working with juvenile sex offenders and would just like to say that there is a huge sucess rate in them never offending again. society today is on a witch hunt to find sex offenders and often it isnt fair. people need to be careful who they label as a sex offender. people can make a mistake and then change, its crazy to me how everyone seems to think that once you cross that line there is no going back

The worst part about the offender registry is the FAMILY has a scarlet letter written on their chests, too. It doesn't only affect the offender. If some of you only knew the kind of discrimination that came about from the registry...I agree that OFFICIALS need to keep a database, but the public gets themselves into hysterics and make life miserable for the families of the offenders. Keep the public off the database. Also, SONAR- the law passed back in April about making sure the social security numbers, licenses and where they are employed are going OVERBOARD. What is the big deal about the offender? Why not the drug dealers as listed in previous comments? Get a Grip, Utah! So much for the Christain value of Love thy neighbors...

more needs to be done to make sure that all sex offenders are registered i have children that range from 2 to 13 and would like to know at least the majority of the threat that my children face in the area that i live so that i can show them what really exists in the world that they live in. so that they might be able to make safer decisions when out with there friends

first of all i would like to say that u CAN NOT compare a sex offender to a drug dealer or a thief or any other criminal, even the prisons dont compare them they have to keep them separate from all the other inmates, for 1 reason and 1 reason only BECAUSE THEY ARE SEX OFFENDERS. i feel no remorse for any of the men and women on that list they are there for a reason, family member or not. i do feel bad for the families that are hurt by what has happened t , but that doesnt change what has already happened. i dont think any of the offenders should be put to death, thats an easy way out, i do think that more could be done as punishment. the sex offender has it easier then the victim, they dont have to go threw life scared over what happened they dont have to be scarred of noises in the dark, and living your life thinking that they did something to deserve it or just anything, they dont have to feel anything. now what about the little babies being hurt and cant do a thing about it, what about the little boys and girls being hurt and not knowing what to do, some people have no idea what its like to be so helpless, and to have to live every day knowing what happened to them was so wrong, and the list in my opinion is one of the best things the law could have done,

i strongly believe that the laws for "sex offenses" need to be re-addressed and ammended, both federaly and on a state level. i was convicted of sexual activity with a minor in 2003. situation: in a twenty-one and older club i met a young lady, we exchanged numbers and a couple weeks later started to hang out, ie; movies, clubs, parties, etc.. after a couple dates we engaged in "sexual activity", sex. After about a month of us hangin out on occasion she revealed to me that she had been lying about her age. she told me she was only 15. at that time i stated that for obvious reasons we could no longer hang out. I later talked to her mother about this situation and discovered that she also new of her daughter lying about her age. i asked her why she encouraged this behaviour. she simply said that her daughter was constantly breaking the law and said when she hung out with me she didnt need to worry about her getting into trouble. Where is the parents responsibility in all this? her father placed her in an inpatient program for troubled teens and she later wrote a biography in which she stated that she had lied to me about her age and that we had had sex. The report was later handed over to the sheriff's department. resulting in my conviction. I served my time, probation and all necessary treatment required by the state. i now have to register as a "sex offender" and lost all my rights. I am married and have been for 5 1/2 years. i am no longer on the "dating scene". why should so much focus be brought in my direction? I agree with the registry for people who have commited crimes against children. I did not Knowingly have sex with an underage female. where is the justice? Her mom provided her with birth control and encouraged this act to take place. shouldnt she be held responsible?? my point is that i made a mistake that could have happened to anyone and does happen more often than not. i paid for that mistake and will pay for it for life. I would like to secure a future for my family and my children, im finding this to be more impossible than not. is the intention of the law to never allow someone who has made a mistake the right to be a respectable citizen in society?

You people who thing that all or even most sex offenders are dirty old men who molest little children are unbelievably deceived!!! Most of them are young men who had some kind of sexual encounter with a juvenile girl who lied about her age. It's embiciles like you who judge everyone without a halo and let others do your thinking for you. These young men, like my son, are suffering an indescribable lifelong torture because of people like you with unbelievable, puritanical, witch-hunt personalities. It's hard to create a truly fair law on registering on the sex-offender registry, because of you who think everyone on the list is out to get little children, you know old guys. Most of them are normal, healthy young men who used poor judgment. Now, you can't tell whom you should fear, because you unreasonable, witch-hunters have that list loaded from stem to stern with normal young people or people who were once young who made that type of mistake. My son was heavily under the influence of his own medications when a 13 year old girl molested him (there were eyewitnesses), but no one cares. He was charged with first degree felony rape of a child JUST because of her age!!! So, now you people who thought you could trust that registry to tell you whom to fear, who think all sex offenders are just crazy from birth and hardwired perverts can't find the real guys to fear, cuz they're buried beneath the literal deluge of those who made mistakes in the foolishness of youth.

I support listing all criminals on a website reguardless of the degree of the crime. I feel bad for the stigma that reaches their families and friends, however, you can tell by reading all these posts that criminals dont like being listed. Maybe fear of being humiliated on a website might make a criminal/wouldbe criminal think twice...and thats a bad thing?! As for sex offenders (please get offended), the victoms suffer all their lives while the offender does his time and gets put on a website for 10 years...BIG DEAL!!! I feel they should suffer like thier victoms IMO. As for drug dealers, how many people committed crimes including armed robbery/rape/murder while on drugs...case closed!

Killer of child: Sandra Cantu: not a sex offender as thought by many. The killer was a Sunday school teacher. She lived next door. (according to many reports) She wasn't on any registry. The victim played with the daughter of the killer, The killer? A woman:Melissa Huckaby Children were crying and scared that the MAN who did it, would get them. Fear. This is just one example (IMHO) of why the registry creates a foolish false sense of security and wastes taxpayer money. The registry makes no child safe! Parents make children safe(IMO).

Most of the people on the registries are there for stupid things like mooning, peeing behind a tree on the side of the road, etc. I know one poor guy that got over 10 years in prison for exactly that. The phrase "sex offender" doesn't mean anything. On top of that, a huge fraction of accusations turn out to be lies, 10% to 60% of them, if the police and prosecutors care enough about not imprisoning innocent people to find the truth. In Salt Lake City, 1% of the men are registered sex offenders, which is so ridiculous. Watch V For Vendetta if you want to see why the government likes to scare people with the registry.

I agree that sex offenders should be severly punished but if a girl of 15 goes out with a man of 21 and lies to him and then her dad presses charges and this man did not have sex with her why should he be treated the same as a man that rapes a child or molests a baby ? I have no use for a child molester and yes he is most definitly a sex offender but there is a differance and they have blanketed all as the same. My dad was 22 and my mom was 15 when they met and were married at 23 & 16 and stayed married for 43 yrs until she died of cancer. This ruins a young mans life for something that happens often and should not be put as a registered sex offender.

actually according to statistics by the Department of Justice, sex offenders are 4 times more likely to commit another sex crime as opposed to those who commited other crimes to recommit the crime they were arrested for

I don't know where you grt your statistics from but you are wrong. You are probably quoteing from heresay, local media,or politicians who like to sensualize the sex offender thing.I am quoteing stats ftom the Department of Justice. Sex offenders have the lowest recidivism rate of any criminal offender except for murders. 93% of new sex crimes are commited by people who don't have a prior conviction for a sex crime. Hmmm, what to say, Im the mother of a victim, and a victim, and the daughter of a mother who refused to see me as a victim, so make that a double victim, Let me warn you if u live in Michigan, u are about to see things get a whole lot worse due to nothing but politics. they are gonna close 8 high level prisons one which houses the perp of my daughter, how will they decide who is gonna be let go for that is the plan to release some, and who they will keep, now i need to ask, of all you people claiming how badly some of these prisoners may have been handled are you ready to live next door to them... send ur little boy or girl out to play when u know hes in the yard next door, and how would u feel if ur friend came over to be with u and thier little girl or boy got raped or worse when these men arent getting the power they want they move it up a notch they kill. what would u do. i want to do something did any body remember the old days when in the 60s protesting was cool well we need to find that voice again stand up and say enough is enough

My ex went ot court and admitted everything he did to our duaghter. He did not go to prison but can have no conatct with the kids that is unsupervised. My question is that can a person be put on the sex offender registry even though he did not go to prison?

Well if you live in Utah County anyone who makes a complain can guarantee that that person will go to prison whether or not that they are guilty. I know someone who passed several lie detector tests and several plethysmograph test there was no physical evidence and the girl even said over the phone to him while he was in jail that her mother was making her do it even though he was innocent and he got 3- 15 year sentences. Tell me the justice in that? In Utah County there is corruption with the judges especially Judge McVay go goes along with whatever the prosecutor wants and will not take the accuseds evidence into consideration everyone is guilty to him!!!! EVERYONE with or without evidence!!!!
