Pursuant to the New Mexico Sex Offender Registration and Notification Act, the release of sex offender registration information is limited to those individuals convicted of certain sex offenses on or after July 1,1995, or those individuals convicted of a sex offense prior to that date and were incarcerated or on probation/parole as of that date.

I have news for ya..it isn't just Californnia. My ex molested our kids in(4) was only prosecuted for Indecent Liberties wiht a minor in a custodial Postion(meaning he asked her for oral sex while he was watching her..thank god she said no). He plead no contest..served no jail time, moved to NM, met his fiancee and made 2 more kids(Both while still on supervised probation!) Probation officers will not do anything. I sent emails where he admits to molesting their youngest..they can check my comp and his they can see who sent what. He lives with his fiancee now and their sons..he babysits them everyday and here's the kicker, He no longer is on the Public Registry! Ya know why? Because he was only charged as a level one(being the lowest threat for recidivism). It is crazy. My daughters were too young to tell what he did, but they all have come forward and told in the past 2 years. I have gotten married, etc..but I am haivng a hard time with the fact the police wouldnt go see if he was around any minors(his own kids). I also called CPS(a sitter called before on them as well). I was told because I only know names not actual addresses thay can only take the report..they can't actually hunt the fiancee down and check on the kids! How about telling Pedophiles they can't live with any kids period! How about telling his fiancee(who he told I framed him) that she cannot have the kids around him. Until more stand up and fight..I really don't see much real change. Everyone seems outraged when a pedophile kills a child, yet the lawmakers let them live in society. There is no cure. In my ex's case there was some question by his little brother and father as to his and his mothers relationship. I guess it was a passed down thing..yet no one in the family will stand against them either. I would like to fight this stuff, I am thinking about taking criminal justice this year..however I don't want to be a probation officer. They apparently have so many sex offender's under their watch, they can't really monitor them effectively. Thanks. :)

I CAN UNDERSTAND YOUR ANGER, AND PAIN. I THINK IT HAPPENS WITH MOST STATES. UNTIL THEY REALLY START GETTING HARSHER, AND REALLY TAKING IN THE PAIN OUR CHILDREN GO THROUGH, AND STOP BABYING THOSE OFFENDERS, AND DO THERE JOBS CORRECTLY, IT WILL ALWAYS BE THIS WAY. IT'S SADD, HURTFULL FOR THE VIC... AND THE FAMILYS, BUT YET TO THEM IT SEEMS NOT TO MATTER. I HAVE HAD ALOT OF PEOPLE NOT AGREE WITH THINGS I MAY TYPE, OR STATE, BUT NO MATTER HOW HARD YOU DO THE MATH IT NEVER WILL ADD UP RIGHT UNTIL SOMETHING STARTS TO BE DONE TOO EITHER LESSEN THIS FROM HAPPENING, OR PLAIN OUT STOP. I think that no sex offenders should ever be released and I think that they should be put in the prison population with no protection. It makes me so angry that these sick pedophiles are given so many rights and protected but no one is willing to put the time and energy into making laws that protect our children. WHAT ABOUT THE CHILDRENS RIGHTS??????????? I would support a law torturing sex offenders on a continuous basis for the rest of their lives because their victims are tortured for their lifetimes with the horror of what these animals do to them!!!!!!!! There is no cure and by releasing them the prison system and court system are setting up more children to be hurt--Parents of a child who has been sexually abused by a known offender should sue the States that let them out, maybe then the laws will change--because thecourts are proving themselves to be negligent in placing a predator back on the streets!!!!!!!

to the ill. and NM post at 816 and 830ish: It is obvious , (IMHO)that you are angry and full of hate regarding this issue. Forget about the offender, for a moment, and think how better it would be if you had a counsellor to talk to about your molestation. The issue of offense is complicated and varies from case to case. What is important, is working through the issue if you were the one molested. Good luck with coming to terms with this.

What in the world do I do? Who do I talk to? I live in Lincoln County and our laws for sexoffenders SUCK! There may as well not be any. A sexoffender cen live near a school,Daycare, you name it. He can even go on school campus!! He can even get a county job. How is this possible??? Someone tell me something....

On December 6th I discovered that I had befriended a Registered Sex Offender. He is a 59-year-old student at New Mexico State University. He had contact with my four minor children, luckily not enough. There need to be tougher laws to protect our children in New Mexico. As the law stands now, when these type of offenders are off probation, they are "free" to live where ever they want and interact with whomever they choose. WHY? New Mexico needs tougher laws that tell these types of offenders that they CAN NOT live near our schools, daycares, public parks, or our recreation centers. And 1 mile is not sufficient, it needs to be no less than 5 miles. In addition, we need a better notification system. I am living just blocks away from individuals who have been convicted of posessing OR traficking child pornography!!! I did not know.

Call your senator and state representative. Tell them what I have just told you. Do it daily. Do it weekly. PLEASE DO IT!!

2 weeks ago I reported a sex offender to the DCYS since he was living with a 3 year old boy. He had just been convicted 6 months ago for 2 counts of criminal sexual penetration of a 7 year old boy, and was not to be in contact with anyone under 15. I also reported it to probation, nobody cares, there is still a very fresh sex offender living with a 3 year old in direct violation of his probation. Probation doesn't care, nor does the Division of Family and Youth services, I guess they just like the headlines. I've done all I can, comminsioners, congressmen, senators, governor. New Mexico sucks.

Hex: check out the post by "some guy". Something is wrong with this story UNLESS the state has made a decision to allow the guy to take care of his/girlfriend's kid?? Story doesn't gel for some reason. Not the way offender laws are nowadays.

YOu would be surprised by how much they are willing to look the other way in a lot of these cases. In some states these people keep reoffending until someone really gets physically hurt and then they finally do something. You don't get serial rapists and child molesters by locking them up the first few times they get caught. Usually when a person is caught there is a long list of priors that may or may not have gotten prison time. They cost the state money to prosecute and they have no way of recouping it. Trust me .......it happens more than you know.

listen everyone! Im a sexoffender, convicited of gsi- gross sexual imposition for touching a 12 year old boy. i was 18 at the time now im 27 years old. i served 3 years in prison. AS attending sex programs you learn so much about other sexoffenders,yourself and victims. most sex acts occur at home by family members. Anyways i dont want to make this a long comment but it doent matter where a sexoffender lives, if a sexoffender wants to offend, hes or she going to offend. doesent matter if he or she close to a school or in the deserts. The goverment needs to spend more time and study the behaviors of these acts. sex offences will never stop , its in most peoples nature. also it has alot to do with how people grow up. theres so much to tell everyone , but im not a very good person expressing my thoughts in typing. But stop living in fear, the world is bad ,politics, The people running the country are the most dangrous. anyways have good relationships with your kids. talk to your kids about what they like . children commit sex acts to - is that so? but yea, there are dangrous sexoffenders , the ones who never been cought and, is not on the resgister working at schools, church, your husban or wife, your child, I can keep on , because anybody can have the potential to become a sexoffender. stop stressing yourself out about sexoffenders living near, because your worried so much about them -------the very next person who you dont expect thats not resgester. can be rigt there--- talk to your kids

John D.: Believe me when I say that IF the legislatures would use the studies and research (even the Dept of Justice Studies) before they made offender laws, EVERYONE on both sides of this issue would be better off. I have seen experts talk to my legislators for hours, then the session changes and half the lawmakers who just got a handle on this issue, leave office. Inexperienced folks come into office and compose unconstitutional or harmful legislation. The knowledge is out there which tells the best way to handle the offender coming out of prison. Pressure from state police agencies and the like would rather have other rules made. It is a moneymaker for the police departments IF the feds would pay as promised. It appears, now, that the bills will be paid by the states. Surprize! Your taxes should raise soon to cover this legislative mess. Meanwhile, the courts will have to decide things at great expense to the offender. The victim will not get justice, because the state agencies to protect them are having funds redirected to jails and prisons. And so it goes.

The one thing that some of you are overlooking in the posts about New Mexico law, which is weak enough, is that it doesn't cover the entire state. Different tribes have different laws that are different from the state laws. And tribal laws may be much softer than state laws. Plus, none of those guys talk to each other: someone conviced on the Navajo reservation may never have their name show up on a state registry; probably most tribes don't report their offenders to the state. It is like when a drunk is about to get caught, all they have to do is run to the nearest rez and they won't get picked up. Tribal officials want to deal with tribe members on traditional terms, which would be fine, but these guys don't just stay on the rezes and commit crimes elsewhere, too. Tribes should have to divulge their data and names to the states, too.

Indian Tribes: I suggest you read section 127 of the new adam walsh act. It appears that tribes will soon be required to do registry stuff (or maybe I am reading it wrong) I think it is saying that tribes can make laws regarding offenders or the AG will do it for them if he wants.??

Most tribes have the authority to develop sex offender registries and have their own registries rather than cede jurisdiction to state governments under the Adam Walsh Act.



When Congress passed the Adam Walsh Child Protection and Safety Act in 2006, a provision regarding Tribal Sex Offender regiesties was placed into the bill WITHOUT tribal consultation, allowing states to improperly asserting jurisdiction onto reservations in order to monitor sex offenders.



So far at least 212 Tribes that responded to the mandate and 198 adopting resolutions that prevent the state from encroaching on Tribal sovereignty. More than 200 Tribes in six states weren't given that opportunity because the Adam Walsh Act automatically gives PL-280 states authority in Indian Country.



From what I've heard, quite a few Tribes have complained about not being consulted about the provision and persuaded the House to pass a bill to delay implementation of the law but the Senate never took up the measure because Republicans placed a hold on it.



As far as New Mexico goes, I'm not sure exactly which Tribes have implemented their own registry or contracted with the state to provide monitor sex offenders, but I've seen more than a few registered sex offenders on the NM sex offender website that lists registered sex offender's home address as being on the reservation, but you may want to try using a search by zip code.

My three grandchildren are living with a sex offender, whom my son has reported numerous times. The oldest is 8 and the youngest 4. He was convicted of raping a 14 year girl, he's already out of jail and back living with my ex-daughter in law. My son is perfectly willing to take the kids but the state and the court won't listen to him. The authorities believe the mother that he is not around the children because he hides every time they come around. He has not registered as a sex offender and he has been out of jail at least three months. When will something happen to protect the children??

I am a convicted sex affender. convicted in 1984 of rape. She was 19 I was 20 at the time. Shes on parole now for crimes of her own. I never raped her! I dont deny having sex with her, and she doesnt deny having sex with me a week before this so-called rape took place. My mistake was taking a non-jury trial. I was young stupid and didn't know how the court system worked. I even refused a plea deal which would have put me on probation. Instead, I went to trial. It cost me almost 12 years of my life. I'm off parole now . Even my parole officer at the time felt I was never guilty of the crime. The woman is a sick person. I was released in 1996 and soon went to prison again for selling drugs. And rightfully so. I desirved it. was released in 2003, finished off my parole. But because I ended up back in prison and still owed time for the rape case, I fell under the new sex affender laws after I was released. I am a level 2.

I have to live with this the rest of my life! I'm a good person who would never hurt anyone, least of all a child. I HATE those type of people! Sex affender doesnt mean JUST a child victim. But because a 19 year old woman didnt want to face her mother as to why she was out all night doing coke while the mom was watching her kid, she said three guys raped her (friends of hers).

I dont hide the fact of why I was in prison. Everyone in my city knows it, and they know her. No one believes it. Because people know me. I'm the type of guy you WANT living next to you. I would never allow anything to happen to you or your kids. And I'm not some 98 lbs weakling. And I dont look the other way if something is happening.

So think what you want about sex affenders. One day someone like me may come to your aid.

My sister and I were victims of a sexual predator over 35 years ago. He was my brother-in-law (now ex- AND deceased... hallelujah!). This guy had everyone fooled... handsome, life of the party... but he was evil and only my sister and I knew it. The abuse occurred at a time when sexual abuse was not talked about... it was a taboo subject. At any rate, he got caught... trying to have sex with me... and that was the end of that. It was, and in some ways still is, a hush-hush subject in our family. Imagine my shock when I learned that my daughter was also victimized by a family member years later... I thought I, of all people, would know the signs. I didn't and it still haunts me to this day. With lots of counseling, my daughter and I are great... we've dealt with the demons and know that we are strong! My sister on the other hand continues to have issues... even 35+ years later. It's sad. The bottom line is... sexual molestors never get better... they are our true menaces in society. Locking them up doesn't help ... locking them up and throwing away the key doesn't help. They call the condition "a sickness"... I don't buy it... they are "wired wrong" and need to be put out of their (and our) misery. The way a child molester is attracted to kids is the way heterosexuals are attracted to the opposite sex and the way homosexuals are attracted to the same sex... is there a cure for that?... uhhhhhhhh no! So... what do we do with them? Well, if we are truly a just society and want to truly protect our kids... child molesters and sexual predators need to be EXECUTED! No ifs, ands, or buts about it! Those who do not agree are blind and ignorant. You cannot "counsel" or "treat" these people... an attraction is an attraction. Wake up people!

yolanderM: I must be one of the blind ones, for I know that many of these offenders have been rehabilitated and go on to develop families and work at jobs as successful people. I do not deny your anger over this. I DO reject all of the people who were molested and now want revenge on the rest of the world. Each case is different. Now, would your relatives be on a registry today? No. Not until they were reported. It is registration that I object to, because it is being used for revenge and to give a false sense of security to the public. AS a country, we can do better than this with better education, awareness and reporting of this crime. Be aware that many children do not report molestation today, because they don't want their parent's or uncle's photo on the web to further victimize and embarrass them. This was reported by recently by CSOM.

My daughter was molested years ago by a pastor in a small town Lordsburg NM also i did all I could to make sure he got what he deserved, funny in the end behind my back the DA gave him a slap on the hand.. wks b4 his probation was over I got enough proof to finally make him spend some time in jail, and now he is a REGISTERED SEX OFFENDER!!! I am so proud of my efforts it's sad that we have to fight to get these sick people to pay for their sick criminal wrongdoings. Our laws do need to change but only we can make that happen YES write to THE ATTORNEY GENERAL ANYONE WHO WILL LISTEN IT WILL PAY OFF I PROMISE!! GOOD LUCK

i dont think these individuals have the right for any type of privacy. whether or not they did their time, people in the communities where these offenders live, need to know who is in their community with their children, brothers and sisters. i could care less what happens or is said to them. they dont realize what they were convicted of and the crime they committed against their victim, is something the victim will never forget, no matter how much counseling. they destroyed lives forever. what was once sacred to a man or women will never be given back

Does anyone know how far a sex offender must live from a school in Bernalillo County? Also, what offenses qualify to keep them away from schools? I only ask because an offender lives near my children's elementary school in Tijeras. A middle school is also right next to the elementary school. It doesn't say that he did anything with children or minors so I am not even sure distance law would include him. I am glad that New Mexico has photos in the registry. I have a child molester living up the road from me, and although I never expect to run into him, at least I would know if I saw him near my home or children. The only thing that I don't like is that I believe some men that in here are getting the short end of the stick. If a girl is 14 and consents to sex with a man that is within 10 years of her age, regardless of a parents feelings, no statutory charges should be brought against him. Unless the girl herself is pressing charges (real rape or violating her while unconcious) then it seems a little cruel to attack him. I know that many young high school girls lie to college aged men about their age.

I am a registered sex offender, my crime having received two pictures of girls under 18 and having sent them back out. I also had sleep deprivation for 8 years which does cause irrational behavior and loss of memory. This is a medical fact. I was never in trouble before or after my conviction or incarceration. I go to school and pay my bills. I register every 90 days. I have never touched or attempted to touch anyone. All sex offenders are not monsters. Just a little news for the haters out there. If a man is drunk and pees in public and a kid is around, he is now a sex offender and must register. The laws do not make a distinction. Where is the internet site that identifies the murders or those arrested for drugs, you get the idea I think.

@Convicted, I totally agree that there should be some sort of leniency based on offense with who has to register. Some parents get up in arms because someone was (past tense) a sexual offender when their crime was something minor.
