Recently a new cal supreme court ruling* held that a man who was acquitted of rape but found guilty by a jury of assault (non -sexual) but the judge at his dicretion persuent to former PC 290 (a)2(E)

made him register as a sex offender because he felt the assault was sexaully moitivated, was entitled to have the registration requirement lifted because due to the restrictions burdens and stigma that registration enhances his sentance above the maxima allowed by statute, and that must be found by a jury not a juge.

So now, I want to know how this would effect someone who was found guilty at a bench trial, and the judge sentanced under the same discretionary clause. There were no arguments heard on this issue during trail so does this ruling effect such a defendant?
